Robles, Rael & Anaya, P.C. secures landmark drinking water enforcement settlement

Robles, Rael & Anaya, P.C. successfully represented the New Mexico Environment Department in a landmark enforcement action against the Camino Real Regional Utility Authority (CRRUA) arising from years of violations of the Safe Drinking Water Act and New Mexico drinking water regulations.

The matter concluded with a negotiated settlement requiring CRRUA to pay $189,000 and resolving five Notices of Violation. The agreement addressed longstanding arsenic exceedances, public notification failures, and other systemic compliance deficiencies while advancing the Department’s efforts to protect public health and ensure regulatory compliance.

The enforcement action marked the first time the New Mexico Environment Department assessed a bad-faith penalty enhancement against a public utility, representing a significant milestone in the Department’s drinking water enforcement program.
