Robles, Rael & Anaya, P.C. prevails in two federal civil rights appeals before the Tenth Circuit

Robles, Rael & Anaya, P.C. recently secured two significant victories before the United States Court of Appeals for the Tenth Circuit, successfully defending governmental entities and law enforcement officers in separate federal civil rights actions.

In Estate of Cristal Cervantes v. City of Las Vegas, et al., the Tenth Circuit issued a published opinion affirming summary judgment in favor of all defendants on both the federal and state law claims. In Estate of Jonathan Molina v. Kevin Smith, the Tenth Circuit likewise affirmed summary judgment in favor of a New Mexico State Police officer, concluding that qualified immunity barred the plaintiff’s excessive force claims. The United States Supreme Court subsequently denied the petition for certiorari in Molina, bringing the litigation to a final conclusion.

These appellate victories further demonstrate the firm’s experience defending constitutional claims involving qualified immunity, law enforcement liability, and complex federal civil rights litigation.
